FILING PROCEDURE

File

The claimant's representative need to file the following documents at the Pretoria offices of AFSA, preferably by e-mail and should receive receipt thereof from AFSA, for a request to be considered "filed":

In matters where parties have agreed to the appointment (only) of an arbitrator / mediator by AFSA:

  1. A brief outline setting out the nature of the dispute including the quantum if any;
  2. A copy of the contract in dispute;
  3. A copy of the agreement to this effect concluded between parties after a dispute has arisen; and
  4. Proof of payment of the appointment fee to the amount of R 5, 000 (excl VAT) / R 5, 700 (incl VAT)

In AFSA administered matters in which the AFSA rules have been agreed between parties:

  1. Completed 'Request for Arbitration' Form;
  2. Copy of the contract in dispute;
  3. Statement of claim / brief outline of the dispute including quantum, if any – with reference to clause 4.2.3 – 4.2.6 of the rules;
  4. Proof of payment to the amount of R 1, 000 (excl VAT) / R 1, 140 (incl VAT) as filing fee OR the total 'first fee' as per the fee schedule

['Submission to Arbitration Form', signed by all parties after a dispute has arisen, should also be filed in the following event(s): If the arbitration clause in the contract does not refer to AFSA; or in the event that the contract in question does not contain any arbitration clause].

In a mediation matter in which the AFSA mediation process has been agreed between parties:

  1. A brief outline setting out the nature of the dispute including the quantum if any;
  2. A copy of the contract in dispute;
  3. A copy of the agreement to this effect concluded between parties after a dispute has arisen;
  4. Proof of payment to the amount of R 1, 000 (excl VAT) / R 1, 140 (incl VAT) as filing fee.
